How long does a lawsuit against an employer take?
If your claim goes to trial, it nearly always takes at least two years. Any appeals will require even more time. If you have been terminated as a result of discrimination, you must find a way of supporting yourself while your case is pending.
What damages are available in an employment discrimination lawsuit?
Back pay is the standard damages award. If you win your case, a judge or jury likely will award you the difference between what you were paid and what you would have received if you had not been discriminated against. If you have suffered extreme distress as a result of the discrimination, you may be entitled to compensatory damages. Punitive damages may be awarded under certain circumstances.
